Terms of Service

These Terms of Service ("Terms") govern your use of this website and your purchase of products from Vanilla and Cinnamon Store LLC ("we", "us", "our"). By using this website or placing an order with us, you agree to these Terms.

1. Products

We sell personalized 5D diamond painting kits produced from images supplied by the customer, together with the tools needed to complete them. Canvas sizes, drill shape and kit contents are described on the product listing at the time of purchase. Because each canvas is printed individually and screens vary, finished colours may differ slightly from what you see on your display.

2. Orders and pricing

A listing is an invitation to purchase, not a binding offer. A contract is formed when we accept and confirm your order. We may decline or cancel an order if the item is unavailable, if the price or description was materially incorrect, or if we suspect fraudulent or unauthorized activity. If we cancel an order you have already paid for, we refund it in full.

Prices are shown in U.S. dollars and exclude applicable sales tax unless stated otherwise.

3. Customer-supplied images

By uploading or sending us an image for personalization, you confirm that:

• you own the image or hold the rights necessary to have it reproduced;
• you have the consent of any identifiable person shown in it;
• the image does not infringe any copyright, trademark, or right of publicity;
• the image is not unlawful, obscene, hateful, or otherwise objectionable.

You grant us a limited, non-exclusive licence to reproduce and adapt the image solely for the purpose of producing and delivering your order. We do not use customer images for marketing, portfolios or any other purpose without separate written permission. We may decline to produce any image at our discretion, and will refund the order if we do. Images are deleted in line with our retention schedule.

4. Shipping and delivery

We ship to addresses in the United States. Production of a personalized kit typically takes several business days before dispatch; estimated delivery windows are shown at checkout or on the marketplace listing. Delivery estimates are not guarantees, and we are not responsible for delays caused by carriers, weather, customs or incorrect addresses supplied by the customer. Risk of loss passes on delivery to the carrier, subject to our handling of lost and damaged shipments below.

5. Returns, damage and cancellation

• Damaged or defective on arrival — contact us within 30 days of delivery with photographs, and we will replace the kit or refund it.
• Missing drills or tools — we ship replacements at no charge.
• Wrong item received — we arrange a replacement and cover return shipping.
• Change of mind on a personalized kit — because each canvas is made to order it cannot be resold, so custom kits are generally not returnable once production has started. Contact us as soon as possible; if production has not yet started we will cancel and refund.

For Amazon orders, please initiate returns through your Amazon account so the marketplace can track the case.

6. Intellectual property

The Vanilla and Cinnamon name, logo, site content and product photography are our property or used under licence, and may not be copied or used without permission. You keep all rights in the images you supply to us.

7. Acceptable use of this website

You agree not to use this website to break the law, to attempt unauthorized access to our systems or those of others, to interfere with its operation, or to scrape it by automated means beyond ordinary search-engine indexing.

8. Disclaimers

This website and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits any warranty or right that cannot be excluded under applicable law, including your rights as a consumer.

Diamond painting kits contain small parts and are not suitable for children under 3 years of age. Adult supervision is recommended for younger crafters.

9. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits or data, arising from your use of this website or our products. Our total liability in connection with any order will not exceed the amount you paid for that order. Some jurisdictions do not allow these limits, in which case they apply only to the extent permitted.

10. Indemnity

You agree to indemnify us against claims arising from an image you supplied to us, or from your breach of these Terms or of applicable law.

11. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

12. Changes to these Terms

We may update these Terms. The "Last updated" date will change when we do. The Terms in force at the time you place an order govern that order.

13. Governing law

These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Orange County, Florida, except where applicable consumer law entitles you to bring a claim elsewhere.
